1. Parties and purpose

Mystic of Mastery, trade name of SD Plus BVBA, sets out this Privacy Policy to transparently inform users about the website hosted at: www.mysticofmastery.com (the “Site”), and about how personal data are collected and processed by Mystic of Mastery, trade name of SD Plus BVBA.

The term “User” refers to any user, whether a natural person or a legal entity, who visits the Site or communicates with the Site in any way.

In its capacity as Controller, Mystic of Mastery, trade name of SD Plus BVBA, determines all technical, legal, and organizational means and the purposes of processing Users’ personal data. Mystic of Mastery, trade name of SD Plus BVBA, undertakes to take all necessary measures to ensure that the processing of personal data complies with the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (the “Law”) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR” or the “Regulation”).

Mystic of Mastery, trade name of SD Plus BVBA, is free to choose a natural or legal person to process Users’ personal data at its request and on its behalf (the “Processor”). Where applicable, Mystic of Mastery, trade name of SD Plus BVBA, undertakes to select a Processor offering sufficient guarantees as to technical and organizational measures for the processing of personal data, in accordance with the Law and the Regulation.

2. Processing of personal data

Use of the Site by Users may lead to the collection of personal data. Processing of these data by Mystic of Mastery, trade name of SD Plus BVBA, in its capacity as Controller, or by service providers acting in the name and on behalf of Mystic of Mastery, trade name of SD Plus BVBA, is carried out in accordance with the Law and the Regulation.

3. Purpose of processing personal data

In accordance with Article 13 of the Regulation, the purposes of processing personal data are communicated to the User. These purposes are:

Execution and delivery of the consultancy, service, download, workshop, program, or training.

4. Personal data that may be processed

The User agrees that, during the visit to and use of the Site, Mystic of Mastery, trade name of SD Plus BVBA, collects and processes the following personal data:

First name, Last name, E-mail address, Telephone number, Company name.

Mystic of Mastery, trade name of SD Plus BVBA, collects and processes these personal data in accordance with the conditions and principles described in this Privacy Policy.

5. Consent

By accessing and using the Site, the User declares that they have read and given their free, specific, informed, and unambiguous consent to the processing of their personal data. This consent relates to the content of this Privacy Policy.

Consent is provided through a positive and active action by which the User ticks the checkbox for the privacy policy via a hypertext link. This consent is an essential condition for performing certain actions on the Site or for enabling the User to enter into a contractual relationship with Mystic of Mastery, trade name of SD Plus BVBA. Any agreement that binds Mystic of Mastery, trade name of SD Plus BVBA, and a User with respect to the services and goods offered on the Site is subject to the User’s acceptance of the Privacy Policy.

The User agrees that the Controller, under the conditions and principles set out in this Privacy Policy, collects and processes their personal data provided on the Site or in connection with the services offered by Mystic of Mastery, trade name of SD Plus BVBA, for the purposes stated above.

The User has the right to withdraw this consent at any time. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

6. Retention period of Users’ personal data

In accordance with Article 13(2) of the Regulation, the Controller retains personal data only as long as reasonably necessary to achieve the purposes for which they are processed.

This period shall in all cases be no longer than 1 year.

7. Recipients of data and disclosure to third parties

Personal data may be transmitted to employees, collaborators, subcontractors, processors, or suppliers of Mystic of Mastery, trade name of SD Plus BVBA, insofar as adequate safeguards are provided for data security and insofar as they cooperate with Mystic of Mastery, trade name of SD Plus BVBA, in marketing products or providing services. They act under the direct authority of Mystic of Mastery, trade name of SD Plus BVBA, and are specifically responsible for collecting, processing, or outsourcing these data.

In all cases, recipients of the data and those to whom the data are disclosed comply with this Privacy Policy. Mystic of Mastery, trade name of SD Plus BVBA, ensures they process these data only for the intended purposes and in a discreet and secure manner.

If data are to be disclosed to third parties for direct marketing or prospecting purposes, the User will be informed in advance so they can give prior and explicit consent to such use of personal data.

8. Data Protection Officer (DPO)

The following person is appointed as Data Protection Officer (“DPO”): Debbie Van der Mercken.

The DPO’s role is to ensure correct implementation of national and supranational provisions regarding the collection and processing of personal data.

9. Users’ rights

The User may exercise their rights at any time by sending an e-mail to: debbie@sdplus.be, or a letter by post with a copy of their identity card to: Seringenlaan 16, 2970 Schilde, Belgium.

a. Right of access

In accordance with Article 15 of the Regulation, Mystic of Mastery, trade name of SD Plus BVBA, guarantees the User’s right of access to their personal data. The User has the right to access these personal data and the following information:

  • the categories of personal data concerned;

  • the recipients or categories of recipients to whom the personal data have been or will be disclosed;

  • where recipients are established in third countries or are international organizations, the appropriate or suitable safeguards;

  • where possible, the envisaged period for which the personal data will be stored or, if not possible, the criteria used to determine that period;

  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the Regulation, and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

The Controller may charge a reasonable fee based on administrative costs for any additional copies requested by the User.

Where the User makes the request by electronic means (e.g., by e-mail), the information shall be provided in a commonly used electronic form, unless otherwise requested by the User.

A copy of the data will be provided to the User no later than one month after receipt of the request.

b. Right to rectification

Mystic of Mastery, trade name of SD Plus BVBA, guarantees the User’s right to rectification and erasure of personal data.

In accordance with Article 16 of the Regulation, inaccurate, incomplete, or irrelevant data may be rectified or erased at any time. The User first makes the necessary changes through their user account, unless these cannot be made independently, in which case the request may be addressed to Mystic of Mastery, trade name of SD Plus BVBA.

In accordance with Article 19 of the Regulation, the Controller shall communicate any rectification of personal data to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The Controller shall inform the data subject about those recipients if the data subject requests it.

c. Right to erasure

The User has the right, in the cases referred to in Article 17 of the Regulation, to obtain erasure of their personal data as soon as possible.

Where the Controller has made the personal data public and is obliged pursuant to the preceding paragraph to erase the personal data, the Controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

The two preceding paragraphs do not apply to the extent that processing is necessary:

  • for exercising the right of freedom of expression and information;

  • for compliance with a legal obligation which requires processing under Union or Member State law to which the Controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller;

  • for the establishment, exercise, or defense of legal claims.

In accordance with Article 19 of the Regulation, the Controller shall communicate any erasure of personal data or restriction of processing to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The Controller shall inform the data subject about those recipients if the data subject requests it.

d. Right to restriction of processing

The User has the right to obtain restriction of processing in the cases referred to in Article 18 of the Regulation.

In accordance with Article 19 of the Regulation, the Controller shall communicate any restriction of processing to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The Controller shall inform the data subject about those recipients if the data subject requests it.

e. Right to data portability

In accordance with Article 20 of the Regulation, Users have the right to receive from Mystic of Mastery, trade name of SD Plus BVBA, the personal data concerning them in a structured, commonly used, and machine-readable format. Users have the right to transmit those data to another controller without hindrance from Mystic of Mastery, trade name of SD Plus BVBA, in the cases provided for by the Regulation.

When the User exercises their right to data portability under the preceding paragraph, they have the right to have the personal data transmitted directly from one controller to another, where technically feasible.

Exercising the right to data portability shall not adversely affect the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller.

The right to data portability shall not adversely affect the rights and freedoms of others.

f. Right to object and automated individual decision-making

The User has the right, at any time, to object to the processing of their personal data on grounds relating to their particular situation, including automated processing by Mystic of Mastery, trade name of SD Plus BVBA. In accordance with Article 21 of the Regulation, Mystic of Mastery, trade name of SD Plus BVBA, shall no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the User, or for the establishment, exercise, or defense of legal claims.

Where personal data are processed for prospecting purposes, the User has the right at any time to object to processing of personal data concerning them for such prospecting, including profiling to the extent that it is related to such prospecting.

Where the data subject objects to processing for prospecting purposes, the personal data shall no longer be processed for such purposes.

g. Right to lodge a complaint

The User has the right to lodge a complaint regarding the processing of their personal data by Mystic of Mastery, trade name of SD Plus BVBA, with the Data Protection Authority competent for Belgian territory. More information is available at: https://www.gegevensbeschermingsautoriteit.be/.

The User may also bring an action for an injunction before the President of the Court of First Instance of their place of residence.

10. Cookies

The Site uses cookies to distinguish Users of the Site. This enables us to offer a better browsing experience and improve the Site and its content. The purposes and methods of cookies are set out in this article.

a. General principles

A “Cookie” is a file placed temporarily or permanently on the User’s device when viewing the Site in view of a subsequent connection. Cookies allow the server to recognize the User’s device.

Cookies may also be installed by third parties with whom Mystic of Mastery, trade name of SD Plus BVBA, collaborates.

11. Limitation of the Controller’s liability

The Site may contain links to third-party websites not linked to Mystic of Mastery, trade name of SD Plus BVBA. The content of these sites and compliance with the Regulation and the Law fall outside the responsibility of Mystic of Mastery, trade name of SD Plus BVBA.

The holder of parental authority must give express consent for a minor under 16 years to disclose personal information or data via the Site. Mystic of Mastery, trade name of SD Plus BVBA, strongly recommends that persons exercising parental authority over minors promote responsible and safe use of the internet. The Controller cannot be held liable for the collection and processing of personal information and data from minors under 16 whose consent is not effectively covered by that of their legal parents, nor for incorrect data, particularly regarding age, entered by minors. Under no circumstances will personal data be processed by the Controller if the user indicates they are under 16 years of age.

Mystic of Mastery, trade name of SD Plus BVBA, is not responsible for loss, damage, or theft of personal data, in particular as a result of viruses or computer attacks.

12. Security and protection

The Controller implements technical and organizational measures to ensure an appropriate level of security for the processing and collection of data. These security measures depend on implementation costs in relation to the nature, context, and purposes of the processing of personal data.

The Controller uses standard encryption technologies within the IT sector when transmitting or collecting data on the Site.

13. Changes to the Privacy Policy

Mystic of Mastery, trade name of SD Plus BVBA, reserves the right to amend this Privacy Policy to comply with legal obligations. Users are therefore invited to consult the Privacy Policy regularly to stay informed of any changes and adjustments. Such changes will be posted on the Site or sent by e-mail to ensure enforceability.

14. Applicable law and competent court

This Privacy Policy is governed exclusively by Belgian law. Any dispute shall be submitted to the courts of the judicial district of the registered office of Mystic of Mastery, trade name of SD Plus BVBA.
